Terms & Conditions
These Terms govern the relationship between Lumexoravintkd s.r.o. (the “Operator”) and the users of the lumexoravintkd.com platform. The platform provides crowdfunding services in accordance with Regulation (EU) 2020/1503.
1. Definitions
Platform — the lumexoravintkd.com website and related applications. Investor — a natural or legal person investing funds into a project. Project — a specific developer initiative financed via the platform.
2. Registration and verification
Registration is free. Before the first investment, the investor must successfully complete KYC/AML verification. The Operator reserves the right to refuse registration to persons who do not meet the statutory requirements.
3. Investing and risks
The minimum investment is €100. Investing in real estate involves risks, in particular construction, legal, market and liquidity risks. The value of your investment may decrease. Past performance does not guarantee future returns.
4. Fees
An entry fee of 1.5% of the invested amount is charged at deposit. A performance fee of 10% is charged on the profit on successful project completion. Detailed fee schedules form part of each investment package.
5. Rights and obligations of the parties
The Operator shall provide services with professional care and transparently inform investors about the progress of each project. The Investor is obliged to provide true data and to duly fulfil contractual obligations.
6. Out-of-court dispute resolution
The parties shall first attempt to resolve any disputes amicably. Consumers have the right to refer the dispute to the Slovak Trade Inspection or to use the European Commission’s ODR platform. Otherwise, the competent court is the general court of the Operator.
7. Final provisions
These Terms are governed by the law of the Slovak Republic and the European Union. The Operator reserves the right to amend them and will inform registered investors of any changes in good time.
